What is actionable intrusion?  It generally involves some action that would be offensive to a reasonable person, and in some area that is considered private.  For example, in disputes involving insurance it is not illegal for a defendant to watch and follow the plaintiff as long as it is in a public place. Taking it one step further, a court held that it was not an invasion of privacy for a wife to place a tracking device on her husbands car.  It may, however, be an issue if it was the police that did it as it could be a violation of the persons constitutional rights.

Who is tracking me online?

Being online is a double-edged sword. If you’re not prepared, you will end up not only losing your clients, but giving their information to potentially dangerous people.

In case you have a privacy policy in your campaign, you’re protecting your customers, while gaining their trust at the same time. As it pertains to your customer, nothing is more vital than their trust and security. When they find that your website gave out information, willingly or not, they will likely stop using your services.

What is FISA?

At least 50 nations around the globe have enacted privacy statutes in order to safeguard their citizens’ personal information as they surf the Internet. US companies involved with ecommerce need to familiarize themselves with the laws of the jurisdictions in which they will be doing business. Each jurisdiction has its own unique privacy laws, which vary in depth and breadth. Research in the US on this topic is in need of interpretation and further investigation, so would benefit from inclusion in international relationships at the global and global economic level. One of the lesser known statutes out there is the Foreign Intelligence Surveillance Act (FISA).  The question is, what is FISA?

Is there a right to Privacy in the Constitution?

Contrary to popular belief, the right to privacy is not enshrined in the United States Constitution. That’s right, the word is nowhere to be found.  We asked Aaron Kelly, an Arizona Attorney what he thought and this is what he said.

The Bill of Rights does imply certain privacy protections — the privacy of beliefs (1st Amendment), the privacy of your home (3rd Amendment), the privacy of your person and possessions (4th Amendment), and the privacy of certain types of personal information (5th Amendment).

Understanding Privacy Policies

A privacy policy is a legal document, an enforceable contract, that tells visitors to your website how your business will collect, use and safeguard any personal information you obtain from them. If you have detailed Privacy Policy that details exactly how you collect and use PII, but you violate your own Policy, you can subject yourself to legal liability to your visitors who relied on the Privacy Policy terms you said you would follow. It is a two-way street, the customer is “agreeing” to provide PII under the terms you say you will be using it for, but if you misuse data or otherwise don’t uphold your end of the bargain, you can be taken to court as well.
